3. Products and Services

Product Availability

All products are subject to availability. While we strive to keep inventory up to date, some items may be unavailable.

Custom Orders

  • We will work with you to ensure your order meets your specifications.

  • Custom orders are subject to availability and may incur additional fees for modifications.

Cottage Food Law Compliance

Carmel Cakery LLC operates under the Texas Cottage Food Law.

  • Our products are homemade in a kitchen not inspected by the Texas Department of State Health Services.

  • We are permitted to sell only non-potentially hazardous foods directly to consumers within Texas.

4. Orders, Payment & Confirmation Policy

Order Approval

  • All orders are subject to approval based on schedule, ingredients, and design specifications.

  • We will notify you promptly if adjustments are required or if we are unable to fulfill your request.

Payment Requirements

  • Full payment (or a deposit for custom orders) is required to secure your order.

  • Orders are not confirmed until payment is received. A confirmation receipt will be provided.

  • To ensure availability, we recommend placing orders as early as possible.

Pricing

  • Prices are listed on our website and may be adjusted at any time.

  • Pricing changes do not affect confirmed orders.

Payment Methods

  • Payments must be made at checkout via the accepted methods listed on our website (credit/debit cards, etc.).

  • By providing payment details, you confirm you have the legal right to use the payment method.

Deposits & Final Payments

  • A non-refundable deposit of 50% is required for all custom orders.

  • The remaining balance is due one week before pickup/delivery.

  • Orders under $150 and those placed with less than 7 days’ notice require full payment at booking.

  • If payment is not received by the due date, we reserve the right to cancel the order.

5. Delivery & Pickup

Delivery

  • We deliver within specified areas. Fees are calculated at checkout.

  • Delivery times are estimates and may vary.

Delivery Policy

  • We take care to deliver your order in perfect condition.

  • Once the delivery is complete, Carmel Cakery LLC is not liable for any damage caused by the client, guests, venue staff, or other vendors.

Pickup

  • Orders can be picked up at our location. Please arrive at the specified time to avoid delays.

  • Once items leave our premises, we are not liable for damage due to transportation, handling, or other external factors.

Liability Disclaimer for Pickup

  • We are not responsible for any accidents, injuries, or incidents on our premises.

  • Please exercise caution when visiting our location.

6. Cancellations & Refunds

Custom Orders

  • A 50% non-refundable deposit is required at booking.

  • Cancellations made less than 4 weeks before the pickup/delivery date will not be refunded.

Standard Orders

  • Refunds for standard orders are considered on a case-by-case basis (e.g., errors on our part).

  • Refund requests must be made at the time of pickup or delivery.

Errors or Quality Concerns

  • If you believe there is an issue with your order, notify us immediately upon pickup or delivery.

  • If a valid issue is found, we may offer a replacement or store credit.

  • Refunds are only issued after reviewing the claim.

Non-Refundable Items

  • Refunds will not be issued for consumed items unless a valid quality issue is identified.

  • No refunds for custom designs or flavors once made according to specifications.

7. User Conduct

By using our website and services, you agree not to:

  • Engage in unlawful behavior or violate these Terms & Conditions.

  • Use our services for fraudulent, malicious, or illegal activities.

  • Interfere with website functionality.

  • You may not copy, reproduce, or distribute any content without our express permission.

9. Limitation of Liability

Carmel Cakery LLC will not be liable for:

  • Any claim exceeding the amount paid for the product or service in question.
